1. Who you are contracting with
EVA is operated by Tax Deed Eva LLC, a limited liability company formed in Wyoming, United States, with its registered address at 30 N Gould St Ste R, Sheridan, WY 82801, United States. In these Terms, "we" and "us" mean that company, and "you" means the person using the service.
2. Accepting these Terms
By creating an account or using EVA you accept these Terms. If you do not accept them, do not use the service. If you are using EVA on behalf of a company, you confirm you may bind it.
3. What EVA is — and what it is not
EVA is a research tool. It collects information about tax deed and foreclosure auctions from official public sources, organises it, and links back to those sources so you can check it yourself.
- EVA is not investment advice, legal advice or tax advice, and nothing on the platform is a recommendation to bid on any property.
- EVA is not a party to any auction, does not represent any county or court, and cannot register, bid or pay on your behalf.
- EVA does not replace your own due diligence. Before you bid, confirm every critical fact with the county and, where it matters, with your own lawyer.
4. About the information shown
Auction information changes constantly. A property can be redeemed, withdrawn, rescheduled or sold between our last collection and the moment you look at it, and county sources are themselves sometimes incomplete, delayed or wrong.
- We show, for each property, where the information came from and when we last saw it, so you can judge how fresh it is.
- We do not warrant that the information is complete, current or accurate, and we do not guarantee that every property going to auction appears on the platform.
- The official source always prevails over what EVA shows. Where they disagree, the county is right.
5. Your account
- You must be at least 18 years old to create an account.
- Your account is personal and non-transferable. Sharing credentials, or using one account for several people, is a breach of these Terms.
- You are responsible for what happens under your account. Tell us straight away if you believe someone else has access to it.
- The information you give us when signing up must be true and kept up to date.
6. Plans, free trial and payment
- The free plan includes a trial period. When it ends, access to paid features stops unless you choose a paid plan.
- Paid plans are billed in advance, in US dollars, through our payment processor. We do not receive or store your card details.
- A subscription renews for the same period unless you cancel before the renewal date. Cancelling stops the next charge; it does not refund the period already running.
- We may change prices. A change never affects a period already paid for, and we will tell you before it applies to your renewal.
7. Acceptable use
While using EVA, you agree not to:
- resell, redistribute or republish the platform’s data as a product or service of your own;
- extract data automatically at scale — scraping, crawling or bulk downloading — beyond the export features we provide;
- share your access with people who do not have their own account, or work around plan limits;
- attempt to break, overload, probe or gain unauthorised access to the platform or to another user’s data;
- use EVA for anything unlawful, or in breach of the rules of any auction.
8. Intellectual property
The platform, its interface, its texts and its brand belong to us. Your subscription gives you the right to use the service, not ownership of any part of it. The underlying public records belong to nobody in particular — what is ours is the collection, organisation and presentation of them.
9. No warranties
EVA is provided "as is" and "as available". We do not warrant that the service will be uninterrupted or error-free, nor that it will meet any particular purpose of yours. Some jurisdictions do not allow certain warranties to be excluded; where that is so, this section applies only as far as the law permits.
10. Limitation of liability
To the fullest extent the law allows, we are not liable for lost profits, lost opportunity, or indirect or consequential damages arising from your use of EVA — including a bid placed, or not placed, on the basis of what the platform showed. Our total liability is limited to the amount you paid us in the twelve months before the event giving rise to the claim.
11. Suspension and termination
You may close your account at any time. We may suspend or close an account that breaches these Terms, that is used fraudulently, or that puts the platform or other users at risk. If we do so without cause, we refund the unused portion of the period you paid for.
12. Changes to these Terms
We may update these Terms. The date at the top always says when they last changed, and a material change is announced before it takes effect. Continuing to use EVA after that means you accept the new version.
13. Governing law and venue
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. Any dispute arising from them is subject to the courts of that State, and both parties agree to that venue.
